A. General Provisions
1. Scope of the terms and conditions
1.1 The business relations between the customers and the online shop www.linsenmax.ch are unconditionally subject to the following General Terms and Conditions (GTC).
1.2 The sale of products, services, and offers by Linsenmax to its customers is exclusively subject to these GTC. The customer acknowledges the GTC in the version valid at the time of placing the order or using the services of Linsenmax. Linsenmax does not recognize any general terms and conditions presented by the customer. Any verbal or telephone agreements that deviate from these GTC must be confirmed in writing in order to be valid. Communication by e-mail or fax shall be deemed to be in writing. The party initiating the communication shall bear the burden of proof of receipt of the communication. Written confirmation is also required for any changes to this written form clause.
2. Offer and Conclusion of Contract
2.1 The presentation of products on the online store www.linsenmax.ch does not constitute a legally binding offer but rather an invitation for the customer to submit a binding order (offer to conclude a contract).
2.2 The online store assumes no liability for the accuracy of product information provided by manufacturers.
2.3 By clicking the order button, the customer submits a binding order for the products listed on the order page.
2.4 Immediately after receiving the order, the online store confirms receipt of the order via email. The purchase contract is only concluded when the online store confirms dispatch of the goods via email (order or shipping confirmation), or, at the latest, upon delivery of the goods.
2.5 In the case of advance payment, the purchase contract is concluded upon confirmation of receipt of the advance payment by the online store.
3. Delivery
3.1 For orders of CHF 100 or more, delivery is free of charge and is carried out by PostPac Priority, within Switzerland only. For orders below CHF 100 (value of the goods), a surcharge of CHF 7 for shipping and packaging will be charged.
3.2 Shipments abroad are not possible.
3.3 The delivery is ensured according to the services of the Swiss Post. The online shop www.linsenmax.ch declines any liability for undelivered shipments. The customer is obligated to inspect the goods upon receipt to verify their completeness and integrity. In the event of complaints regarding damaged packages, the customer is requested to contact us promptly via email at fragen@linsenmax.ch. The specifications of the contact lenses ordered by the customer are binding.
4. Delivery time
4.1 As a rule, Linsenmax delivers within 5 to 10 working days after receipt of payment. However, depending on the availability of the products, the delivery time can be extended.
5. Right of Return
5.1 Linsenmax agrees to accept the return of any products purchased on the online store www.linsenmax.ch, provided they are returned in their original, undamaged condition and sealed packaging, within 14 days.
5.2 Refunds will be issued using the same payment method as was used in the original transaction, unless expressly agreed otherwise with the customer.
6. Return Shipping
6.1 Goods to be refunded as a result of exercising the voluntary right of return may be sent to the following address:

6.2 The costs of return shipping are at the customer's expense.
7. Contact lens subscription
7.1 The contact lens subscription service allows the customer to automatically receive products they have previously selected (contact lenses and/or care products) and according to the frequency defined by the client.
7.2 In the event of insolvency, Linsenmax will suspend delivery until payment is received.
7.3 The customer can change the date of the next shipment or cancel this service at any time.
7.4 The customer or Linsenmax AG may terminate the contract at any time.
7.5 The customer can take advantage of special offers that are specifically compatible with this option. However, the contact lens subscription service does not automatically entitle the customer to benefit from other current special offers and promotions.
7.6 Linsenmax undertakes to notify the customer in the event of the non-availability of a cleaning product and/or contact lenses featured in the subscription. In the absence of a response from the customer within 10 days of notification by email, Linsenmax will replace the unavailable product with one possessing the same properties.
8. Contact lens claims
8.1 Contact lenses for which a complaint has been made must be returned in a container suitable for contact lenses and in a suitable storage solution.
8.2 In order to make a proper return, the customer must mention: the batch number, the customer number, the order number and the correction of the lens. Only then can the supplier process the complaint.
8.3 Complaints about contact lenses that are dried out cannot be processed. No defect can be demonstrated.
9. Quality
9.1 All items sold on the online store www.linsenmax.ch are products from well-known brands. However, if the customer wishes to submit a complaint, they may contact Linsenmax via email at fragen@linsenmax.ch. Linsenmax will make every effort to find a resolution and ensure customer satisfaction.
10.1 All prices are inclusive of Swiss VAT. Any shipping costs for purchases in the online store are not included in the displayed sales price and will be charged to the customer. The prices valid at the time of the order shall apply.
10.2 All prices are quoted exclusively in Swiss francs (CHF / Fr).
11. Payment methods and terms
11.1 Linsenmax offers various payment options, including credit card, PostFinance Card, TWINT, Paypal, and payment by invoice.
11.2 For payments by credit card, Paypal, or Postcard, the account is charged immediately upon transmission of the acceptance confirmation from Linsenmax. Both credit card and Paypal transactions are processed via SIX Payment Services. For more information on Paypal, please visit www.paypal.com.
11.3 The customer will receive their invoice as soon as the order has been dispatched. Linsenmax reserves the right to perform credit checks on its customers. Linsenmax may, without providing any further justification, exclude certain payment methods in general or for individual customers. Further information is available on the payment methods page.
11.4 MF Group / POWERPAY, as an external payment service provider, offers the payment option "Purchase on Invoice." With a single invoice, online purchases can be settled by invoice. Payment by invoice must be completed within 30 days of receipt of the invoice.
If payment is not made within the specified timeframe, the customer will receive a monthly invoice with an order summary by post in the following month. Upon conclusion of the purchase contract, POWERPAY assumes the receivables and handles the corresponding payment arrangements. By choosing the "Purchase on Invoice" payment option, the customer accepts the General Terms and Conditions of both Linsenmax and POWERPAY.
Under this contract, MF Finance AG / PowerPay grants a consumer credit in accordance with Art. 12 of the Swiss Consumer Credit Act (Konsumkreditgesetz - KKG), provided that the flexible payment option is utilized and no exclusion grounds pursuant to Art. 7 Para. 1 KKG apply. The dunning fees can be found in Paragraph 13 of the Powerpay General Terms and Conditions.
For partial payments, at least 10% of the outstanding invoice amount must be paid each month. This allows the customer the flexibility to decide in how many installments to settle the invoice. Linsenmax waives the administrative fee of CHF 2.90 for the first invoice.
12. Retention of title
12.1 The goods delivered remain the property of the online store www.linsenmax.ch until delivery is completed. Changes of address must be communicated without delay; otherwise, the customer shall bear the costs of address verification.
13. Data protection
13.1 After the conclusion of the contract, all orders are stored at Linsenmax. The customer's personal data required for the execution of the contract shall be saved in a customer account. The data is saved as soon as the customer has registered in the online store and accepted these GTC and the data protection declaration.
13.2 If the customer wishes to delete a customer account, he/she should contact our customer service via e-mail: fragen@linsenmax.ch.
14. Liability
14.1 Linsenmax makes every effort to present the products shown in the online store with the greatest possible care. However, we reserve the right to make errors, misprints and changes to the technical data and colors of the products shown in the online store.
14.2 For colored lenses, the colors of the photographic reproductions may vary from reality. It must be taken into account that the result that the customer obtains will depend entirely on the natural color of his eyes. It is therefore best to discuss this with your specialist. In addition, we make every effort to continuously update our product images to reflect suppliers' current packaging, but Linsenmax cannot provide a guarantee for packaging changes. Linsenmax expressly reserves the right to change its prices and products as well as its delivery conditions at short notice.
15. Applicable law and jurisdiction
15.1 Swiss law exclusively governs these Terms. The place of jurisdiction is Meyrin.
16. Black Friday 2024
16.1 The “3 FOR 2” Black Friday offer, also known as “3 products for 2 purchased” is valid from 01.11.2024, 00:01 to 02.12.2024, 23:59 on all products available on the www.linsenmax.ch website or the Linsenmax app. To benefit from the offer, simply add a minimum of 3 items to your basket. The offer applies to the least expensive product in the basket and can be applied indefinitely (e.g., for 6 products added to the basket, the 2 least expensive are free). To benefit from the offer, please insert the above-mentioned promotional code before the payment stage. The offer cannot be combined with other offers and promotional codes. It does not apply to orders placed as part of the AboMax lens subscription. The general terms and conditions of sale apply.
Remarks
By ordering online, the customer certifies that:

They have been wearing contact lenses for more than 6 months without any problems.

The information about their contact lenses corresponds to the values given to them by a specialist.

They adhere to the recommended wearing duration for contact lenses.

They have had a check-up with their ophthalmologist within the last 12 months and the specialist has not advised them to stop wearing lenses.

They are fully aware of their ophthalmologist's instructions regarding the care and handling of lenses.

They agree to cease wearing lenses immediately if they experience any discomfort and will consult their ophthalmologist.
